1. This Misc. Second Appeal has been preferred against judgment and
order dated 05-07-2024, passed in Misc. Civil Appeal No. 1 of 2016 by the
Judge, District Council Court at Shillong.
2. The brief facts are that the predecessor in interest of the appellant, as
the original plaintiff had instituted a suit being T.S. No. 3 of 2014, before
the Subordinate District Council Court at Shillong, against the respondents
for declaration of Right, Title Interest and Ownership over the plot of land
located at Tynring Village, more particularly described in the plaint itself.

3. Thereafter, interim injunction was granted in favour of the appellant
plaintiff on 25-02-2014, which was subsequently made absolute on 03-10-
2016.
4. An appeal was thereafter preferred by the respondent No. 1 before
the Judge, District Council Court, who then passed the impugned order
setting aside the order of injunction passed by the Subordinate District
Council Court.
5. This Court then by order dated 20-09-2024, passed in MA(S) No. 3
of 2024, while admitting the appeal for hearing, had directed that status quo
be maintained with regard to the suit land. Today, when the matter has been
called for hearing, the learned counsels for the parties jointly submit that as
the Title Suit has been pending for a long period of time without any
progress, the parties are agreeable if status quo be maintained and the suit
be directed to be proceeded with expeditiously.
6. In consideration of the submissions of the learned counsels for the
parties, it is hereby directed that status quo shall be maintained by the parties
with regard to the suit property till the disposal of the Title Suit. It is also
directed that the Title Suit be proceeded with most expeditiously considering
that it has been instituted as far back as in 2014.

7. On the terms as agreed upon above, the appeal stands closed and
disposed of.
8. Lower Court record to be returned back.
