Constitution of India is at the instance of the plaintiffs
praying for a direction upon the Learned Civil Judge
(Senior Division), 2nd Court at Barasat, North 24-Parganas
to dispose of the pending applications in Title Suit No.801
of 2021 expeditiously.
In view of the order sought and proposed to be
passed, this Court is of the considered view that there is
no necessity to direct issuance of any notice upon the
other opposite parties. However, the learned advocate on
record of the petitioner shall be obliged to forward a copy
of this application along with this order upon the other
opposite parties or upon the learned advocates
representing such opposite parties before the Learned
Trial Judge.
From the order-sheets appended to this application,
this Court finds that 29th April, 2025 was fixed for hearing
of the petition under Section 151 of the Code of Civil
Procedure and Order 7 Rule 11 of the Code of Civil
Procedure, Order 18 Rule 18 of the Code of Civil

Procedure, Order 11 Rule 3 of the Code of Civil Procedure.
In the light of the said submission made by learned
advocate for the petitioners, CO 2474 of 2025 stands
disposed of by requesting the Learned Civil Judge (Senior
Division), 2nd Court at Barasat, North 24-Parganas to take
up the hearing of the pending interlocutory applications
filed in Title Suit No.801 of 2021 on the next date fixed
and to make an endeavour to dispose of the same as
expeditiously as possible, if the same are otherwise ready
for hearing, without granting any unnecessary
adjournment to either of the parties.
With the above observations, CO 2474 of 2025
stands disposed of.
There shall, however, be no order as to costs.
Urgent certified photocopy of this order, if applied
for, be supplied as expeditiously as possible.
