This is second application filed on behalf of the applicant under
Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular
bail in relation to FIR No.332/2023 dated 06.07.2023, registered at Police
Station Mangavan, District Rewa (M.P.) for commission of offence under
Sections 8, 21, 22 of Narcotic Drugs and Psychotropic Substances Act, 1985
and section 5/13 of Drug Control Act. Applicant is in detention since
06.07.2023.

2. Applicant’s first bail application was dismissed as withdrawn and not
pressed vide order dated 27.02.2024 passed in M.Cr.C.No.2923/2024.
3 . As per the prosecution story, on 05.07.2023 on the basis of secret
information received from the informer, the house of Rajkumar was raided.
When police entered into the house, Rajkumar Soni and Prakash Soni
attempted to pick and conceal three sacks kept near the stairs. They were
apprehended. They were made understand with the information received and

with their right to get searched from some gazetted officer or magistrate but
they gave consent to give search to the A.S.I. Siyasharan Rawat.
Panchnamas were prepared. In total 736 bottles of Wings and Onerex cough
syrup having codeine phosphate with Chlorpheniramine Maleate worth
Rs.1,47,200/- were seized after following the provisions of the Act.
Recovery was made from the conscious possession of the applicant Prakash
Soni and Rajkumar. F.I.R was registered. After investigation charge sheet
has been filed.
