1. Through the medium of the instant petition, which has been

preferred under 528 BNSS, 2023, the petitioner has sought

quashment of challan/filing no. 1796/2023 and registration

no. 125/2023 pending for disposal before the learned

Presiding Officer POCSO Court, Jammu titled UT of J & K

Vs. Harjinder Singh for the commission of offence

punishable under Section 376 IPC and 3/4 of the POCSO

Act.

2. Learned counsel for the petitioner submits that both the

parties i.e. petitioner and respondent no. 2 have settled their

disputes amicably and have since married together.

3. Issue notice to the respondents, which is waived by Ms.

Saggira Jaffer, Advocate appearing vice Mr. P D Singh,

learned Dy. AG on behalf of the respondent no. 1. She seeks

and is granted two weeks’ time to file response to the instant

petition.

4. Now, notice shall go to private respondent only.

5. List on 11.03.2025.

6. Meanwhile, Mr. Ratta is directed to assist the Court that in

light of the dispute between the parties having being resolved

amicably, the impugned FIR registered against the petitioner

under Section 376 of the IPC read with 3/4 of the POCSO

Act and also the proceedings arising out of the same can be

quashed. He further undertakes to produce the petitioner as

well as respondent no. 2 before this Court for recording of

their statements on the next date of hearing before the

Registrar Judicial.
