This is a suit filed by the plaintiff against the defendants
for the relief of declaration and injunction.
2. The brief averments of plaint is as follows: –
The plaintiff and 1st defendant were married in 1975 and
their children, Sri.Pavan Kumar Shetty and Smt.Swathi Shetty,
are living separately. The 1st defendant is a Retired Bank
Employee who took Voluntary Retirement Scheme (VRS) in
2000 and after retirement, he started practicing as an Advocate.
He has been earning a substantial income, including pension,
and owns several properties in Mysore and Udupi.
2(a). The 2nd defendant, a 36 years old woman, is
involved in an illicit relationship with the 1 st defendant. Despite
being married and living in Sirsi, she has been responsible for
instigating the 1st defendant to harass the plaintiff, leading to her
physical and mental abuse over the last 10 years.
