, and in Times of India (English), dated 02.09.2022,
was accepted and was kept on record. All the near relatives of the
testator, namely (i) Dr. Arun Kumar Chaudhary, (ii) Smt. Sheela
Jha and (iii) Smt. Neelu Mishra appeared through Vakalatnama
in the instant testamentary case. The aforesaid NRs did not
choose to file any caveat or objection to grant of letters of
administration in favour the applicant. Moreover, the appeared
Near Relatives did not cross examine the witnesses produced on
behalf of the applicant though they were represented through
their respective learned counsels.
05. In order to substantiate the claim made in the
Patna High Court TEST CASE No.4 of 2019 dt.20-02-2025
instant testamentary application, altogether three witnesses,
including one attesting witness of the Will, have been examined
on behalf of the applicant, namely (i) attesting witness of the
Will, Dipak Mishra (AW-1), (ii) the applicant, Anand Kumar
Chaudhary (AW-2) and (iii) Samir Chaudhary.
