(2 of 1974) , S.386— Sentence – Legality – Offence of culpable homicide not amounting to murder – Deceased was not admitted to hospital on date of incident – Death occurred after 15 days from date of occurrence after he was discharged from hospital – Neither cause of death mentioned in post-mortem report nor evidence of witness proved that injuries inflicted upon deceased resulted in his death – Incident was already thirty-six years old and all accused persons were above 70 years of age – High Court rightly imposed sentence of period already undergone by accused as well as fine of Rs.16,000/- on each accused to be paid to family of deceased.
