1. The present appeal is filed by the original claimant
under Section 30 of the Employees Compensation Act being
aggrieved and dissatisfied with the impugned judgment and
award dated 30.07,2009 passed by the learned Workman
Compensation Commissioner, Surat in Compensation
Application being WC (Non Fatal) Case No.119 of 2007. By
the said impugned judgment and award, the learned
Commissioner has partly allowed the claim application,
thereby, awarding compensation to the tune of Rs.3,59,686/-
with 9% interest and 5% penalty and has also awarded cost of
NEUTRAL CITATION

Rs.1000/- by holding respondent no.1 liable to pay penalty and
costs and respondent no.2 liable to pay amount of
