The complainant has filed the present complaint under
Section 200 of Cr.P.C. against the accused for the
commission of an offense punishable under section 138 of
Negotiable Instruments Act.
2. The case of the complainant in brief is as under:-
“The complainant and accused are known to each
other and accused was oftenly borrowing the loans from
accused. The complainant has paid Rs.5,95,000/- through
bank and cash from 18.07.2018 to 01.02.2019. In the
month of February 2019, accused had promised to repay
the said amount within one year. Thereafter on demand by
the complainant, accused had issued cheque bearing
No.483853, dated 08.01.2020 for Rs.5,95,000/- drawn on
Corporation Bank, CHBS Layout, Vijayanagar, Bengaluru.
On presentation through his Banker Axis Bank, Vijayanagar
C.C.No.2383/2021
Branch, Bengaluru and same has been returned for the
reason “Funds Insufficient” on 03.02.2020.
