1. In the order dated 20.03.2025, passed by this Court, the

submission of Mr. Harris Moosa, learned for the petitioners had been

recorded that the petitioners were willing to pursue the matter by filing

a statutory appeal before the Customs authorities, and that the matter be

closed before this Court. It was also prayed that the period spent

pursuing the matter before this Court be given consideration for

exclusion on the question of delay, when the appeal is taken by the

Commissioner of Appeals.

2. Dr. N. Mozika, learned DSGI assisted by Ms. K. Gurung,

learned counsel for the respondents has no objection to the said

submission, he only submits that the appeal will be taken up in

accordance with law.

3. The submissions are duly recorded.

4. Accordingly, the matter is closed by allowing the writ

petitioners to pursue the matter by filing a statutory appeal. With regard

to the period spent pursuing the matter before this Court, the same shall

be given due consideration, on an appropriate application being filed,

before the Appellate authorities.

5. The matter stands closed and disposed of.
