2. The brief facts of the prosecution case are as follows:
(a) PW.3, Sri T.S. Umesh, runs a shop at Bukkadibailu bus
stand. On 18.02.2016, he came to his shop as usual at 8:00 a.m. to
open it. At that time, many people had gathered there, noticing
posters pasted on the walls of his shop. He also observed posters
containing Naxal literature on the walls of his shop, the compound
wall, the wall of the bus stand, and the water tank. These posters
urged people to boycott the election and provide basic needs to the
villagers. Therefore, PW.3 lodged a first information statement with
PW.1, Sri Manjeshwar. Based on this information, PW.1 registered a
case in Crime No. 15/2016 for offences punishable under Sections
120B and 121 of the IPC, and Sections 13 and 18 of the U.A.(P) Act,
and took up the case for investigation.
