The Investigating Officer, Sri Abdul Ahad, the Deputy
Superintendent of Police, has submitted a charge sheet against
accused No. 6 and other accused persons for offences punishable
under Sections 143, 144, 147, 448, 506, 120B, and 121 read with
Section 149 of the Indian Penal Code, 1860 (‘IPC’), Sections 3 and
25 of the Indian Arms Act, 1959 (‘Arms Act’), and Sections 13 and 18
of the Unlawful Activities (Prevention) Act, 1967 (‘U.A.(P) Act’).

2. The brief facts of the prosecution case are as follows:

(a) PW.1, Sri Chittanna, and his team of officers, along with
the SP and Dy.S.P. of the Anti-Naxal Force, were collecting
information about Naxal activities on 21.09.2007. The superior
officers of PW.1 received information that the Naxals had visited the
house of CW.1, Sri Achutha, two days before. Therefore, PW.1 and
his team visited the house of CW.1, Sri Achutha, on 21.09.2007 and
recorded his statement. CW.1, Sri Achutha, informed PW.1 that on
19.09.2007, at around 7:00 p.m., the wife of his brother came to his
house. He, his daughter Smt. Padmavathi, and his brother’s wife
PW.4, Smt. Rathnamma, were talking to each other. At around 8:30
p.m., four men and four women arrived at their house wearing
clothes similar to KEB Lineman-colored uniforms. They were armed
with guns and threatened them at gunpoint to provide food. His
daughter then provided food to them. Out of the eight persons, one
person handed him two handbills. They threatened him with dire
consequences, saying they would take away their lives if he
disclosed their visit to the police. While leaving, they shouted
slogans: “ನಕ್ಸ ಲರಿಗೆ ಜಿಂದಾಬಾದ್, ಮಾವೋವಾದಿಗಳಿಗೆ ಜಯವಾಗಲಿ.”
