State of Manipur & 3 ors. Respondents

BEFORE
HON’BLE MR. JUSTICE AHANTHEM BIMOL SINGH
01.04.2025
Heard Mr. Ch. Ngongo, learned senior counsel assisted by Ms. S.
Gangarani, learned counsel appearing for the petitioner; and Mr. Shyam
Sharma, learned G.A. appearing for the respondents.

The present writ petition has been filed assailing the order dated
07.02.2014 by which the petitioner has been placed under suspension as
well as the order dated 31.08.2023 extending the period of suspension of
the petitioner. It has been submitted by the learned senior counsel
appearing for the petitioner that during the pendency of this writ petition,
the petitioner has been reinstated in service by issuing an order dated
01.03.2025 issued by the Commandant, 5th Bn. Manipur Rifles,
Khongjaron, and that since the petitioner has already been reinstated in
service, no cause survives for adjudication in the present writ petition.

The learned senior counsel, however, submitted that despite the
issuance of the order dated 01.03.2025 reinstating the petitioner in
service, the petitioner has not been allowed to submit his joining report
and he has not been given his posting and to join his service.

In view of the above, the petitioner has submitted a representation
dated 24.03.2025 to the Director General Police, Manipur, requesting for
2

allowing him to join his service with effect from 01.03.2025 and that the
said representation is still pending for consideration by the authorities.

The learned senior counsel submitted that the present writ petition
as well as the connected application can be disposed of by issuing a simple
direction to the Director General of Police, Manipur, to consider the said
representation dated 24.03.2025, submitted by the petitioner and to
dispose of the same by issuing a speaking order within a stipulated period.

Mr. Shyam Sharma, learned G.A. appearing for the respondents,
submitted that he has no objection in disposing of the present writ petition
as well as the connected application as prayed for by the learned senior
counsel appearing for the petitioner.

Taking into consideration, the facts and circumstances of the
present case and the submission advanced by the learned counsel
appearing for the parties, this Court is of the considered view that it will
be in the interest of justice to dispose of the present writ petition as well
as the connected application by directing the Director General of Police,
Manipur, to consider the said representation dated 24.03.2025 submitted
by the petitioner, requesting for allowing him to joint service w.e.f.
01.03.2025 and to dispose of the same as expeditiously as possible by
issuing a speaking order within a period of 15(fifteen) days from the date
of receipt of a certified copy of this order.

Ordered accordingly.

With the aforesaid direction, the present writ petition as well as the
connected application is disposed of.

JUDGE
Indrajeet
