1. Heard Sri Rajesh Pandey, learned counsel for the applicants and Sri Rajeev Kumar Singh, learned AGA for the State.
2. The present application has been filed for the following relief:
?It is, therefore, most respectfully that this Hon’ble court may graciously be pleased to allow Misc. Application and quash impugned order dated 09-10-2024 the passed by Special Judge (NDPS Act)/Fast Track Court Pilibhit, wherein the learned concern court rejected the Discharge Application as 20Kha in under section 498A,323,506,354,504 IPC and 3/4 D.P. Act against the Applicants no.1 and impugned order dated 05-08-2024 passed by Additional District and Session Judge/FTC (Prevention of Women Cruelty Act), Pilibhit wherein the learned concern court also rejected the Discharge Application as Kha-7, and Kha-11 against the Applicants no. 2 and 3 and both impugned order passed in Session Trial No. 240 of 2024 in Case Crime No. 230 of 2020 (State Vs. Shivam Gangwar and others) in under section 498A,323,354,376,377,504 and 506 IPC and section 3/4 D.P. Act Police Station-Jahanabad District-Pilibhit and it is further prayed that the Hon’ble Court may kindly be pleased to stay impugned order dated 09-10-2024 the passed by Special Judge (NDPS Act)/Fast Track Court Pilibhit, wherein the learned concern court rejected the Discharge Application as 20Kha in under section 498A,323,506,354,504 IPC and 3/4 D.P. Act against the Applicants no.1 and impugned order dated 05-08-2024 passed by Additional District and Session Judge/FTC (Prevention of Women Cruelty Act), Pilibhit wherein the learned concern court also rejected the Discharge Application as Kha-7, and Kha-11 against the Applicants no. 2 and 3 and both impugned order passed in Session Trial No. 240 of 2024 in Case Crime No. 230 of 2020 (State Vs. Shivam Gangwar and others) in under section 498A,323,354,376,377,504 and 506 IPC and section 3/4 D.P. Act Police Station-Jahanabad District-Pilibhit, during the pendency of the above noted case before the Hon’ble High Court, otherwise the applicants shall suffer loss and injury.?
