1. Heard learned counsel for the applicant as well as learned A.G.A. for the State.

The present application under Section 483 Cr.P.C. read with Section 529 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed for a direction to respondent No. 1 / Additional Chief Judicial Magistrate, Court No. 37, Sultanpur to decide the Crl. Misc. Case No. 410 of 2022 Arising out from Complaint Case NO. 1902 of 2020, U/S-138 of N.I. Act, Police Station – Lambhuwa, District Sultanpur.

3. Contention of learned counsel for the applicant is that though this complaint under N.I. Act was filed in the year 2022, but the trial could not yet be concluded. It is further submitted that as per Section 143(2) of N.I. Act, the trial for the offence under N.I. Act should be conducted on day to day basis and it is further provided u/s 143(3) that the trial should be concluded within six months from the date of filing of the complaint.
