The present interim bail application under Section 483 of
BNSS (439 Cr.P.C.) has been filed by the petitioner who has been
arrested in connection with F.I.R. No.569/2024, registered at
Police Station Sangariya, District Hanumangarh for offences under
Sections 103(1), 109(1), 115(2), 126(2), 191(2), 191(3) and 190
of BNS.
The bail application has been filed by the petitioner on the
ground that marriage of his brother namely Gurmeet Singh is
scheduled to be solemnised on 10.04.2025. In this regard, learned
counsel for the petitioner has placed on record the marriage card.
The factum of marriage of the petitioner’s brother is also fortified

from the report dated 07.04.2025 received from the SHO, Police
Station Sangariya, District Hanumangarh.
Learned counsel for the petitioner submits that as the
marriage of petitioner’s brother is to be solemnised on 10.04.2025
and the functions of the marriage ceremony are to be undertaken,
the presence of the petitioner is essential. In such circumstances,
it is prayed that the petitioner may be released on interim bail for
a period of 10 days.
Learned Public Prosecutor has opposed the interim bail
application, however, he has not disputed the factum of marriage
of petitioner’s brother.
Having considered the facts and circumstances of the case,
so also the fact that marriage of petitioner’s brother is to be
solemnised on 10.04.2025, this Court deems it just and proper to
grant interim bail to the accused petitioner for a period 10 days.
Accordingly, the interim bail application filed under Section
483 of BNSS (439 Cr.P.C.) is allowed and it is directed that
petitioner Harpreet Singh @ Happy S/o Tara Singh, arrested
in connection with F.I.R. No.569/2024, registered at Police Station
Sangariya, District Hanumangarh be released on interim bail for a
period of 10 days, provided he furnishes a personal bond in a sum
of Rs.1,00,000/- with two sound and solvent sureties in the sum
of Rs.50,000/- (out of which one surety will be a close relative of
the petitioner) each to the satisfaction of learned trial court for his
surrender on completion of 10 days from the date of his actual
release.

Let this bail application be again listed on 21.04.2025.
Learned Public Prosecutor shall be required to submit the
compliance report of the order as to whether the petitioner has
surrendered or not.
