3. Present applicant- Surendra Meht o
is praying for regular bail in relat ion t o
FI R dat ed 12.03.2003 regist ered as FI R
No. 259 of 2003 at P.S. Kiccha Dist rict
Udham Singh Nagar wherein t he present
applicant has been charge sheet ed for
t he offence punishable under Sect ions
363, 366 and 376 I PC.

4. Learned counsel for t he applicant
subm it s t hat t he applicant is innocent
and has been falsely im plicat ed. Apart
from t his, aft er com plet ion of
invest igat ion charge sheet has already
been filed and t he t rial has been
com m enced. He furt her subm it s since
charge sheet has already been filed
t herefore t here is no need of cust odial
int errogat ion of t he present applicant .
Apart from t his he subm it s t hat t he
applicant is languishing in j ail since
22.09.2024 and he has no previous
crim inal hist ory.

5. On t he ot her side, learned St at e
counsel has not disput ed t his fact t hat
t he charge sheet has already been filed
and t he t rial has been com m enced and
t he applicant has no previous crim inal
hist ory.

6. Aft er hearing t he argum ent s of t he
learned counsel for t he part ies, and
furt her t aking int o considerat ion t hat
charge sheet has already been filed and

t here is no need of cust odial
int errogat ion of t he applicant , t his Court
is of t he view t hat t he applicant deserves
for bail.

7. Accordingly, t he bail applicat ion is
allowed.

8. Let t he applicant Surendra Meht o
be released on bail on his execut ing a
personal bond and furnishing t wo reliable
suret ies of t he like am ount t o t he
sat isfact ion of t he court concerned.
