Mr. Pankaj Kumar, learned counsel for the petitioner is
present.

2. Mr. S.C. Dumka, learned AGA and Ms. Sweta Badola
Dobhal, learned Brief Holder for the State are present.

3. Heard.

4. By means of the present writ petition, petitioner has
challenged the FIR No.0014 of 2025 dated 21.01.2025, under
Section 409 of IPC, registered with Police Station Dalanwala,
District Dehradun.

5. The dispute as raised in the first information report is
regarding the valuables kept in Locker No.38 maintained in
Bank of Baroda, Branch Dalanwala, District Dehradun which
was broken by the bank authorities on 01.02.2022 and the
valuables found therein were taken away. The complainant
lodged the first information report alleging robbery against the
bank officials of the relevant time. Though the petitioner is not
named in the FIR but he was an employee of the Bank on the
relevant date.

6. Learned counsel for the petitioner submits that valuables
were taken from the Locker No.38 of the Bank after breaking it
for the reason that despite several notices and intimations sent to
the holder (respondent no.4), she did not turn up. He further
submits that valuables were recorded and an inventory was
prepared, which is at page no.38 of the paper book of the writ
petition; and the property is kept sealed in the Head Office of the
Bank.

7. Learned counsel for the petitioner was asked by this court
to show the rules which empower a bank official to break open a

locker in case of failure of locker holder to respond to the
intimations; he was further asked to submit as to how the
valuables viz. Jewellery etc. kept inside the Locker could be
returned to the complainant. However, learned counsel for the
petitioner is unable to respond to the aforesaid queries, and he
seeks time to answer the same.

8. As prayed for, list this matter on 21.04.2025 as fresh
enabling learned counsel for the petitioner to answer the queries
made by this Court.
