Ms. Asmi, learned counsel for the applicant.
2. The prayer made in this C528 application is to
direct the Court below to expedite the proceedings of
Case No.536 of 2024 (Vishal Gupta v. Vaishali Gaurav)
pending before the Court of First Additional Principal
Judge, Roorkee, District Haridwar, under Section
13(1)(i-a)(i-b) of the Hindu Marriage Act, 1955 and to
decide the same within a fixed period of time.
3. Of-late, the Apex Court in the case of ‘Sangram
Sadashiv Suryavanshi v. State of Maharashtra’ (Criminal
Appeal No.4758 of 2024 decided on 25.11.2024 [2024
INSC 899]) has held that Constitutional courts may
issue directions for the time-bound disposal of cases
only in exceptional circumstances. The issue of
prioritizing the disposal of cases should be best left to
the decision of the courts concerned where the cases are
pending.
4. In view of the aforesaid legal authority, the Court
finds that the present case does not fall within the
category of ‘exceptional circumstances’ as the case is
only of the year 2024.
5. Accordingly, C528 application is dismissed.
6. Pending application if any, stands disposed of.
