Heard Learned Counsel for the petitioner and
Learned A.P.P for the State.
2. The petitioner is apprehending arrest in connection
with Fatehpur P.S. Case No.109 of 2020, for the offence
punishable under Sections 109, 147, 148, 149, 332, 337, 353,
153(A), 295, 295A, 297, 427, 186, 188, 269, 270, 504, 506 and
304 of the IPC read with Section 3 of the Prevention of Damage
to the Public Property Act, 1984.
3. As per the prosecution, the FIR has been lodged
against 65 named and 250-300 unknown accused persons with
allegation that they have created nuisance and obstructed the
police in discharge of official duty.
4. Learned Counsel for the petitioner submits that the
petitioner is innocent and has committed no offence. Counsel
also submits that the petitioner is resident of place of occurrence
and at the instance of police, his name has been inserted in this
Patna High Court CR. MISC. No.9658 of 2025(2) dt.11-04-2025

case.
5. Counsel further submits that criminal antecedent of
the petitioner is clean and other co-accused persons have been
granted bail by the Co-ordinate Bench of this Court vide order
dated 18.02.2025 passed in Cr. Misc. No.6096 of 2025 and vide
order dated 22.01.2025 passed in Cr. Misc. No.509 of 2025.
6. Learned APP for the State opposes the prayer for
bail of the petitioner and submits that criminal antecedent of the
petitioner is clean.
7. In the present facts and circumstances of this case
and the submissions made above, let the petitioner above
named, be granted bail, in the event of arrest or surrender before
the Trial Court within a period of 4 weeks from today, on
furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand)
each with two sureties of the like amount each to the satisfaction
of Addl. Chief Judicial Magistrate-Xth, Gaya in connection with
Fatehpur P.S. Case No.109 of 2020,, subject to the following
conditions as laid down under Section 438(2) of Cr.P.C.
