This second application for bail under Section 439 Cr.P.C. has
been filed by the petitioner who has been arrested in connection
with FIR No.149/2022 registered at Police Station Gulabpura,
District Bhilwara, for offences under Sections 8/15, 25 and 29 of
the NDPS Act.
Learned counsel submitted that as per the prosecution,
during routine nakabandi at National Highway 148 D, New Abadi
Khari, Lamba Chauraha, on 05.04.2022 at about 11:45 am, a
team of Police Station Gulabpura flagged down a white coloured
Hyundai i-20 car having registration No.GJ-04-CJ-5367 and after a
search of the offending vehicle being made, the police recovered
contraband (poppy husk/straw) weighing 123.100 Kgs. from six
black coloured plastic bags from the conscious possession of the
present petitioner as well as the driver co-accused- Mahendra
Vishnoi. Both were arrested on the spot.
