The present application for bail under Section 483 of BNSS
(439 Cr.P.C.) has been filed by the petitioners who have been
arrested in connection with F.I.R. No.309/2023, registered at Police
[2025:RJ-JD:18393] (2 of 4) [CRLMB-7000/2024]
Station Bhim, District – Rajsamand for the offences punishable under
Sections 147, 148, 302, 201 & 120-B read with Section 149 IPC.
Heard learned counsel for the petitioners and the learned Public
Prosecutor. Perused the material available on record.
Learned counsel for the petitioners submitted that the accused
have been falsely implicated in the present case. He further
submitted that the co-accused Kishore Singh, Chetan Singh and
Devendra Singh have been enlarged on bail by the learned trial Court
itself vide orders dated 26.02.2024, 17.02.2024 and 05.03.2024
respectively. Learned counsel further submitted that the co-accused
Kishan Singh has been enlarged on bail vide order dated 16.05.2024,
passed by a Coordinate Bench of this Court in S.B. Criminal Misc. Bail
Application No.5774/2024. He submitted that the case of the
present petitioners is not distinguishable than that of the co-accused
persons who have already been enlarged on bail. He, therefore,
prays that the present petitioners be also enlarged on bail.
