Brief Case of the Prosecution:
1. The criminal law machinery was set into motion on 05.01.2014,
when DD no. 30A, Ex. PW3/A was registered at PS Gokal Puri at 11:15
AM, wherein it was recorded that “Gali No.5, New Mustafabad
Jhagda” . The said call was made from mobile no. 7503215155 and the
same was marked to ASI Shiv Shankar for further action as per the law.
2. The Inquiry Officer ASI Shiv Shankar reached the spot along-with
Ct. Kunji Lal and found that the injured persons were already removed to
GTB Hospital by the PCR van. Thereafter, IO ASI Shiv Shankar reached
the said hospital and obtained the MLC no. C7/14, Ex. PW7/A of the
injured Jakir S/o Ali Hasan, MLC No. C38/14, Ex. PW8/A of injured
Sabbir S/o Ali Hasan and the MLC No. A56/14 of the complainant Jahid
S/o Ali Hasan. In the said MLCs the concerned doctor had opined the
injured persons to be “fit for statement” and the said injuries were
received by them through a blunt edged object. Furthermore, the nature
of injuries on the said MLCs were kept under opinion. In the said MLCs,
the alleged history of assault at 11:00 AM on 05.01.2014, was recorded
upon what was stated by the injured persons. The IO then recorded the
statement of the complainant Mohd. Jahid, Ex. PW2/A, in the hospital
itself.
