1. This Court has perused the material available on record.

2. The petitioner has been arrested in connection with FIR

No.204/2021 of Police Station Kotwali Churu, District Churu for the

offences punishable under Sections 341, 323, 307, 427 & 143 IPC.

He has preferred this bail application under Section 483 BNSS /

439 Cr.P.C.

3. Counsel for the petitioner submits that the co-accused

Mohammed Tofik has been enlarged on bail by the Coordinate

Bench of this Court vide order dated 27.09.2024 in SBCRLMB

No.6885/2024. He submits that the case of the petitioner is

similarly situated to the co-accused – Mohammed Tofik. Learned

counsel for the petitioner submits that the charge-sheet has been

filed and as per the medical report all the injuries are simple in

nature. He submits that the petitioner is behind the bars since

20.01.2025, thus, his bail application deserves to be granted.

4. Learned PP as well as learned counsel for the complainant

opposes the bail application.

5. Having regard to the totality of the facts and circumstances

of the case as also the fact that conclusion of the proceedings is

likely to take some time and without expressing any opinion on

the merits of the case, this Court deems it just and proper to

grant bail to the accused petitioner under Section 483 BNSS/439

Cr.P.C.

6. Accordingly, this bail application filed under Section 483

BNSS / 439 Cr.P.C. is allowed and it is directed that petitioner

Samad Kureshi S/o Saleem Kureshi shall be released on bail in

connection with FIR No.204/2021 of Police Station Kotwali Churu,

District Churu provided he executes a personal bond in a sum of

Rs.50,000/- with two sound and solvent sureties of Rs.25,000/-

each to the satisfaction of learned trial court for his appearance

before that court on each and every date of hearing and whenever

called upon to do so till the completion of the trial.
