ORDER:

The present writ petition is filed under Article 226 of the Constitution of

India seeking the following relief:

“…to issue appropriate writ, direction, order or orders, more particularly one in
the nature of Writ of Mandamus in questioning the action of the respondents
in not releasing bill payment for the work i.e.. Comprehensive Restoration of
Yerramreddy Cheruvu near Yerramreddypalli (V) in Pulivendula (M) of YSR
District in respect of the bill amount of Rs.39,39,979/- for the work executed by
the petitioner despite the claim for the payment of bill amount is raised (Token
No.2024-172088) as illegal, arbitrary and violative of Article 14 and 21 of the
Constitution of India and consequently direct the respondents to release an
amount of Rs.39,39,979/- towards the bill amount for the works executed by
the petitioner and to pass such other orders as may be deem fit and proper in
the circumstances of the case.”

2. Heard learned counsel for the petitioner as well as learned Government

Pleader for Finance and Planning appearing for respondent No.2.

3. Today, when the matter came up for hearing, learned counsel for the

petitioner submits that the 5th respondent has passed the bill for net amount of

Rs.31,55,068/- on 30.01.2024 and the bill was uploaded in CFMS portal and

token number was generated as 2024-172088, but the bill amount is not yet

released.

4. In view of the aforesaid submission, the Writ Petition is disposed of

directing the respondents to release an amount of Rs.31,55,068/- (Rupees

thirty one lakhs fifty five thousand sixty eight only) in favour of the petitioner,

within a period of one (1) month from the date of receipt of a copy of this

order, with interest at 12% p.a. The interest shall be computed from the date

of expiry of one month from the date of submission of the bill by the petitioner

till the date of payment. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
