The petition has been filed inter alia seeking a writ of

mandamus directing the respondents to pay monthly gross salary to the

members of petitioner-Association, who are working as Assistant Professors

on contractual basis, as is being paid to regularly appointed Assistant

Professors.

2. There is no representation on behalf of the petitioner-

Association for the last four dates of hearing. No one has appeared on its

behalf even today.

3. Learned counsel for the University contends that members of

the petitioner-Association have been engaged as Assistant Professors on

contract basis in the University, and as per their terms of appointment they

are entitled to minimum of pay scale meant for the post which is being paid

regularly. The specific stand of the University to that effect is apparent from

its short reply, dated 18.02.2025, which is as under:

7. That during the pendency of the captioned petition before
this Hon’ble Court, the University has already enhanced the
salary of the contractual Assistant Professors in pay level 10 i.e.
Rs. 57,700/- + D.A. @ 7% = Rs.61,739/- since August, 2018.

Thereafter, it was enhanced in the pay level 10 i.e. Rs.57,700/-
+ D.A. @ 50% i.e. Rs.28,850/- = Rs. 86,550/ w.e.f. 19.06.2024
vide order dated 28.06.2024. The University vide Notification
dated 10.01.2025, copy appended herewith as Annexure R-1/1,
enhanced the salary of the contractual Assistant Professors in
the pay level Rs.57,700/- +D.A. @ 53% i.e. Rs.30,581/-=
Rs.88,281/- w.e.f. 08.01.2025 as per the D.A. paid to the regular
Assistant Professors. Rs.57,700/- is the minimum of the basis
pay of Assistant Professor in the pay level 10 whereas the
contractual Assistant Professors are being paid Rs.88,281/-
including 53% D.A i.e. Rs.30,581/- by the University. Keeping
in view of the aforesaid facts, the writ petition is not
maintainable and is liable to be dismissed on this ground alone.

4. There is no denial to the facts afore-mentioned. Besides, having

been appointed on contract basis, the members of petitioner Association

cannot be given gross salary payable to regularly appointed Assistant

Professors in violation of their terms of engagement.

5. In view thereof, the petition being devoid of merits and stands

dismissed accordingly.
