The accused in this case is tried for the offence
punishable under Section 138 of Negotiable Instrument Act
1881, on the complaint of the complainant.

2. The summary of the complainant’s case is that:

A complainant is a company incorporated under the
companies Act and is represented through its authorized
person. Accused No.1 is a private Ltd Company represented
through its Directors Sukakumar Puvi Kumar and Jagadeesan
Guhappriya thereby forming an important part of the
management of the firm and engaging in business activities of
accused No.1 private company. The complainant further states

that, accused No.1 through its Director had been ordering
products from out company since 01.04.2019 and the
outstanding amount payable to the complaint is
Rs.39,61,784/- as on 21.07.2022. After so many requests
accused No.1 through its Director had issued a cheque bearing
No.223069 for an amount of Rs.30,00,000/- dtd: 30.06.2022
drawn on ICICI OTC Road, Bangalore Branch, the complainant
had deposited the cheque for realization at complainant’s bank
Citi NA Bank, Bangalore Branch, M. G. Road, but the cheque
was returned unpaid with the remark “Payment Stopped by
Drawer” on 20.07.2022. Later on 25.07.2022 the complainant
got issued the legal notice through RPAD to the accused
person which was duly served on accused on 28.07.2022.
Inspite of the service of notice the accused neither paid the
cheques amount nor replied to the notice and being aggrieved
by the same, this complaint is filed on 08.09.2022 against the
accused for the offence punishable U/Sec.138 of N. I. Act.
