1. This is a ‘commercial suit’ seeking recovery of ₹19,29,000/- (Nineteen
Lakh Twenty-Nine Thousand), with pendent lite and future interest @
24% pa.

1.1. The dispute between the parties is a ‘commercial dispute’ within the
definition of Section 2 (1)(c)(i) of the Commercial Courts Act, 2015,
being a dispute arising out of an ordinary merchant transaction.
1.2. Pre-institution mediation between the parties remained unsuccessful
vide a Non-Starter Report dated 30.07.2021, issued by the concerned
District Legal Services Authority.
