1. This second application for bail under Section 483 BNSS has
been filed by the petitioner who has been arrested in connection
with F.I.R. No.76/2023 registered at Police Station Rajiv Gandhi
Nagar, Jodhpur City West, for the offences under Sections 498-A,
304-B in alternate 302 of IPC, palpably on the ground that after
rejection of the first bail application there is a change of
circumstance as the statements of the material prosecution
witness i.e. Afsana @ Rukhsana (complainant) have been recorded
before the competent criminal Court.
2. The first bail application filed by the petitioner was rejected
by this Court vide order dated 05.09.2023. The order dated
05.09.2023 is reproduced below for ready reference:-
