01. Learned counsel for the petitioners has drawn the attention of this
Court to an order dated 11.07.2024 passed by this Court of learned Judicial
Magistrate 1st Class, Billawar in an application preferred by respondent No. 2
herein, namely, Hari Saran before the Court through his counsel for registration
of an FIR, by virtue of which, a direction was issued to the Incharge Police
Station, Billawar to conduct an inquiry and file a report and the matter was
directed to be listed on 15.07.2024.
02. It is a specific case of the petitioners that no inquiry, as directed by
the Court in terms of Section 173 (3) of the BNSS has been done by the
Incharge Police Station, more particularly, in compliance to the order passed by
the competent Court (mentioned supra) and instead, an FIR was registered by
the police on 15.07.2024 under Sections 447 and 323 of the IPC at Police
Station, Billawar.
