332, 333, 353, 341, 336, 307, 427, 436,
124-A (later added) and 107 of Indian
Penal Code, 1860 and Sections 3/4 of

Prevention of Damage of Public Property
Act, 1984, the present appeal has been
filed.
2) This Court, issued notice on
13.11.2019 and vide order dated
03.01.2022, directed as follows:
“We have heard learned counsel
for the parties at some length. It
appears that even the charges have
not been framed and there is thus no
question of even examining the
independent witnesses. At this stage,
while one of the accused Lokendra
(petitioner in SLP(Crl.) No.
7551/2021) is in custody, other
accused who has been enlarged on bail
is Yogeshraj (respondent Ns. 2 in
SLP(Crl.) 10456/2019 and 10457/2019,
filed by the wife of the deceased
police officer).
The matter is quite serious where
under the pretext of the cow
slaughter, a police officer has been
lynched. Prima facie, it is a case of
people taking law into their own
hand.

We are of the view that Yogeshraj
should be asked to surrender within a
period of seven days from today and
thus to that extent, the impugned
orders granting him bail are stayed.
We call for a report from the trial
Court, Bulandshahr as to how much
time do they need to frame the
charges and to record the testimonies
of the independent witnesses.
List after three weeks.”
3) This Court further by order dated
13.05.2022 directed respondent No.3-Johny
and respondent No.4-David to join as
parties. Thereafter, vide order dated
13.09.2022 respondent No.3 and respondent
No.4 were directed to surrender within a
week. This Court while granting leave on
03.11.2022 granted liberty to the
respondent-accused persons to move to this
Court for bail after examination of eye-
witnesses is done by the Trial Court. The

‘Status Report’ of the progress of the
trial was also directed to be filed within
four months.
4) Interlocutory Application No. 80051 of
2025 is filed by respondent No.2
(Yogeshraj) seeking bail, on the premise
that all the eye-witnesses of the
prosecution have been examined and there
is no chance of him influencing the
witnesses. Therefore, he may be granted
bail during the pendency of the captioned
appeal.
5) We have heard the learned counsel for
the parties at length and after going
through the material placed on record
including the ‘Status Report’ of the trial
is on record as per which the trial is at
the stage of defence evidence, we are

inclined to grant bail to all the three
respondents namely respondent No.2
(Yogeshraj), respondent No.3-Johny and
respondent No.4-David.
6) Considering the aforesaid and the
interim order dated 03.01.2022 referred
above and 13.09.2022, the present appeal
has outlived its utility and the trial is
fixed for defence evidence. Therefore, we
dispose of this criminal appeal with a
direction to release respondent No.2-
Yogeshraj, respondent No.3-Johny and
respondent No.4-David on bail subject to
such terms and conditions as may be fixed
by the trial Court, in connection with FIR
No. 583 of 2018 dated 04.12.2018
registered with Police Station-Syana,
District-Bulandshahar, Uttar Pradesh.

7) We further make it clear that in case
respondent Nos.2, 3 and 4 are found to
have indulged in any criminal acts after
their release on bail, the complainant
would be at liberty to take recourse for
cancellation of bail before appropriate
forum.
8) Direction regarding disposal of trial
at the earliest has already been passed by
the interim orders of this Court which
shall remain intact.
9) Pending application(s), if any, shall
stand disposed of.
