Heard Mr. Gagan Deo Yadav, learned counsel for the
appellants as well as Mrs. Usha Kumari, learned Special Public
Prosecutor for the State.
2. Despite of valid service of notice upon Respondent
No. 2/Informant, no one appears on behalf of Respondent No. 2.
3. This is an appeal under Sections 14(A)(2) of the
Scheduled Castes and Scheduled Tribes (Prevention of Atrocities)
Act, against refusal of the prayer for anticipatory bail by order
dated 30.09.2023 in A.B.P. No. 2141 of 2023 passed by the
learned 1st Additional Sessions Judge-cum-Special Judge,
Patna High Court CR. APP (SJ) No.5097 of 2023(3) dt.22-04-2025
Madhubani in connection with Phulparas P.S. Case No. 103 of
2023 F.I.R. dated 23.02.2023 registered under Sections 341, 323,
308, 379, 504, 34 of the Indian Penal Code and Sections 3(i) (v)
