vacant possession of the petition schedule property within
one month, which is not in accordance with law.

Secondly, the learned counsel has brought to the
notice of this Court that as per Section 162(3) of the Act
speaks that “The Tribunal shall consist of a Chairman
and one other member to be appointed by the
Government” and they alone are competent to pronounce
the order. In the present case, the order has been passed by
a single Member, which is also not in accordance with law.

Thirdly, the operative portion of the order also Contd…
contains a direction that the Endowment Institution is at
liberty to take possession of the property along with
structures therein with the police assistance and that such
an order shall not said to be passed in the present O.A.,
which is against to the object of the Act and due procedure.
