1. The petitioner seeks enlargement on bail in FIR No.447/2020
registered at Police Station Chikhali, Pimpri – Chinchwad, under
Sections 302, 201, 364, 365, 368, 323, 504, 506, 143 and 149 of
the Indian Penal Code, 1860 (in short, the “IPC”), Section 37(1)
read with Section 135 of the Maharashtra Police Act, 1951 and
Sections 3(1)(ii) and 3(4) of the Maharashtra Control of Organized
Crime Act, 1999.
2. It is alleged that; (i) on the night of 11.12.2020, Yogesh
Sawant and 7-8 other persons came to the complainant’s house, (ii)
dragged his son (Sachin) out of bed; (iii) threatened the entire
family to be cut into pieces; and (iv) then they put Sachin into a
white car and drove off. Since Sachin did not return home and his
mobile phone was switched off, a complaint of him having been
abducted was lodged. Later on, the dead body of Sachin was
recovered on 13.12.2020, as a result of which, other provisions
such as Sections 302, 323 and 201 etc. of IPC were also added to
the complaint. The postmortem report revealed the cause of death
to be fatal injuries to the head. There were 14 injuries suffered
by the deceased, in sum.
