[ 9 ] IA Nos. 89083 and 89084 of 2025
1. The present applications have been filed by the present
applicant(s) praying for directions restraining the State of
Punjab from giving effect to the proposal declaring 1 to 3 kms

ESZ area abutting the Sukhna Lake.
2. The notification of the Eco-Sensitive Zone(ESZ) is a
statutory duty of the State and the Union of India. The State
is required to submit a proposal for identifying the ESZ
around the Wildlife Sanctuaries and National Parks.
Thereafter, the proposal is required to be forwarded to the
Union of India, which is then required to notify the ESZ area
in accordance with the procedure prescribed under the Statute.
3. One of the essential requirements is the issuance of the
preliminary notification and providing an opportunity of
hearing to the affected parties.
4. The prayer in the present application(s) for restraining
the State of Punjab from discharging its statutory functions
cannot be granted.
5. The applications are, accordingly, rejected, reserving
the liberty to the applicants to take objections on the
preliminary notification, which would be considered in
accordance with law.
[ 10 ] IA Nos. 82247, 82248 of 2025 and IA Nos. 82524 & 82525
of 2025
1. The present applications have been filed with the
following prayers:
“a) Allow the present Application and direct the
respondent/State to take immediate steps to obtain
permission to the Hon’ble Court, in terms of order
dated 09.05.2024, to extend the period of the mining
lease so as to enable the Applicant to carry out22
mining operations; and
b) Pass an ad-interim ex-parte direction permitting
the Applicant to carry out the mining operations till
such time the respondent/State seeks permission of
this Hon’ble Court in terms of order dated 09.05.2024
and the issue is adjudicated upon by this Hon’ble
court.”
2. It can thus be seen that the prayer is for a direction to
the State to take immediate steps to obtain permission of this
Court, to extend the period of the mining lease so as to
enable the applicant(s) to carry out the mining operations.
3. An ex-parte ad-interim order has been sought so as to
enable the applicant(s) to carry out mining operations till
such time the respondent-State seeks permission of this Court
in terms of order dated 09.05.2024.
4. Mr. Shiv Mangal Sharma, learned Additional Advocate
General appearing for the State of Rajasthan submits that
though the State is processing all such applications for
grant/renewal of mining lease, it is not permitting the actual
mining, unless this Court permits it.
5. In any case, the prayer clause (b) which seeks a
direction to permit mining activities without the express
permission of this Court is totally untenable.
6. The applications are, accordingly, rejected.

1. This matter pertains to a new road being constructed
connecting Village Basai in District Nooh to the State of
Rajasthan. It is the contention of the applicants that the
road is constructed in order to facilitate transport of
illegal mining in the mine situated across the border in
Rajasthan.
2. The report of the Central Empowered Committee (CEC)
supports the stand of the applicants.
3. From the report it appears that neither the Revenue
Authority nor the Chief Secretary of Haryana have responded
to the request of the CEC to attend the joint survey.
4. Issue notice to the State of Haryana.
5. Mr. Akshay Amritanshu, learned counsel, appears and
accepts notice for the State of Haryana.
6. The Collector, Nooh and Deputy Superintendent of Police,
Nooh are directed to ensure that with immediate effect no
work on the said road should be permitted to continue.

1. From the record it is clear that on 08.01.2025 this
Court, after perusing the compliance affidavit of the State
of Rajasthan, had noted that the State had recommended to
constitute a Committee. The terms and conditions were to be
jointly finalized by the Union of India and the State of
Rajasthan.
2. When the matter came up for hearing on 16.01.2025, the
Court recorded that the State of Rajasthan had already
recommended a Committee to be chaired by a retired Judge of
the High Court of Rajasthan.
3. In the said order, this Court had observed that the
Ministry of Environment, Forest and Climate Change (MoEF&CC)
should address the issue at the earliest and take a final
decision with regard to the constitution of Expert Committee.
This Court had further directed that the MoEF&CC to take a
decision prior to 19.03.2025 and report compliance to this
Court. The matter was directed to be kept for hearing on
19.03.2025.
4. On 19.03.2025, learned counsel appearing on behalf of
MoEF&CC sought time till today.
5. Today also when the matter is called out Ms. Archana
Pathak Dave, learned Additional Solicitor General of India,

appearing on behalf of MoEF&CC is not in a position to inform
the Court as to whether a Committee has been constituted or
not.
6. From the perusal of the record, it appears that the
MoEF&CC is taking the matter in a casual manner. When this
Court, vide order dated 16.01.2025, had specifically directed
a decision to be taken prior to 19.03.2025, the MoEF&CC ought
to have taken a decision.
7. Issue notice to the Secretary, Ministry of Environment,
Forest and Climate Change (MoEF&CC) directing him to remain
personally present in this Court at 10.30 a.m. on 29.04.2025
and show cause as to why an action for committing contempt of
the order of this Court dated 16.01.2025 be not taken against
him.

[16] CONTEMPT PETITION(C) DIARY NO. 39857 OF 2024 WITH

1. Mr. K. Parameshwar, learned Amicus Curiae has suggested

certain aspects pertaining to Kolleru Wildlife Sanctuary to be
re-visited by the Central Empowered Committee (for short
“CEC”).
2. We, therefore, request the CEC to inspect Kolleru
Wildlife Sanctuary and submit its report on the following
aspects:
a. Actual status of compliance of the judgement dated
10.04.2006 in T.N Godavarman Thirumalpad v Union of
India, (2006) 5 SCC 47;
b. CEC shall examine the working of the Andhra
Pradesh Wetland State Authority and whether the said
authority continued to monitor the effective
implementation of the Central Wetland Rules and
especially the judgement of this Hon’ble Court;
c. Examine the Status of the boundaries of the
Kolleru Wildlife Sanctuary and the resolution of the
Standing Committee of the National Wildlife Board in
its meeting dated 08.08.2015 and the report of the
working group chaired by Prof. R Sukumar dated
02.01.2017;
d. CEC shall specifically look into the settlement of
private rights and as to whether the same was done in
accordance with the provisions of the Wildlife
Protection Act, 1972 before notifying the sanctuary.”

[17] ISSUE REGARDING ORDER DATED 18.03.2025 PASSED IN W.P.
(C)NO. 13381 OF 1984.
1. A perusal of the order dated 18.03.2025 passed in Writ
Petition (C) No. 13381 of 1984, would reveal that the State
of Rajasthan has issued a notification dated 23.03.2021,
whereby an area of 27.855 square kilometers has been de-
notified which was earlier forming part of Badh Baraitha
Wildlife Sanctuary.
2. Vide order dated 13.11.2000, this Court had specifically
directed that pending further orders, no dereservation of
forests/sanctuaries/national parks shall be effected.
3. Prima facie, the notification dated 23.03.2021 appears to
be in contempt of order passed by this Court dated 13.11.2000.
4. Issue notice to the State of Rajasthan as well as MoEF&CC
calling upon them to explain the situation.
5. Mr. Saurabh Rajpal, learned Advocate-on-Record waives and
accepts notice on behalf of the respondent/State.
6. List this matter/application in the last week of May,

[18] I. A. NOS. 153500 & 153501 OF 2024 WITH I. A. NO. 153502
OF 2024
1. Vide our order dated 20.11.2024, we had recorded the

observations made by the learned National Green Tribunal (NGT)
that the area wherein Saranda Wildlife Sanctuary is situated
consists of pristine forest and it is a repository of some of
the finest Sal trees in the country.
2. We had, therefore, directed the State Government to file
an affidavit to explain as to why the State did not take steps
to implement the directions issued by the learned NGT on
12.07.2022, though a period of two and half years had lapsed
from the date of the said order.
3. When the matter was listed on 20.02.2025, we had
considered the affidavit dated 02.12.2024 filed by the State.
4. We referred to the affidavit filed by one Mr. Aviroop
Sinha, DFO Saranda, Van Bhawan, Chaibasa, wherein it was
stated that the Principal Chief Conservator of Forest Wildlife
(PCCF-WL)-cum-Chief Wildlife Warden (CWLW), Jharkhand vide his
Memo dated 29.11.2024 had moved a proposal to the Government
of Jharkhand for declaration of “Saranda Wildlife Sanctuary”
and “Sasandaburu Conservation Reserve”.
5. We, therefore, expected that the State of Jharkhand would
take a final decision in that regard expeditiously. The matter
was, therefore, directed to be kept today.
6. Today, again an affidavit has filed by the State
Government by the same officer that is Mr. Aviroop Sinha.
7. In this affidavit, it is stated that the proposal which

was received from PCCF-WL-cum-CMLW on 29.11.2024 has been sent
back by the Department of Forest, Environment and Climate
Change, Government of Jharkhand to the Principal Chief
Conservator of Forests (HoFF) on 23.03.2025 for his
examination and comments.
8. It was almost after a period of four months from the date
on which the proposal was received by the State Government
from PCCF-WL-cum-CMLW that the proposal has again been sent
back to the Principal Chief Conservator of Forests for his
comments.
9. We do not understand the propriety of keeping the matters
pending almost for four months, particularly when an
impression was given to this Court in the affidavit dated
02.12.2024 that the matter is being processed expeditiously by
the State Government.
10. The Secretary, Department of Forest, Environment and
Climate Change, Government of Jharkhand is, therefore,
directed to remain present in this Court on 29.04.2025 at
10:30 a.m. and show cause as to why action should not be
taken for dilly dallying the matter without any valid reasons.

2. Vide our order dated 19.03.2025, we had directed the
State of Rajasthan to appoint/nominate a Nodal Officer in the
office of District Mining Office, Alwar. We had further
directed that such officer, on receipt of a
complaint/representation would take a decision on the

grievance of the person making it within a period of two weeks
from making the complaint/representation.
3. It has been further clarified that if such a grievance is
not entertained, the aggrieved person can approach the
jurisdictional High Court for raising their grievance.
3. In light of the aforesaid order, we do not find any
reason to entertain the present application.
4. If the applicant(s) so desire, they can get the benefit
of the order dated 19.03.2025 and make a representation to the
Nodal Officer.
5. The applications are, accordingly, disposed of.
[ 22 (a) & (b)] I.A. No. 263809 of 2023 with I.A. Nos.

1. This special leave petition challenges the order dated
21.10.2024 passed by the Division Bench of the High Court of
Punjab and Haryana at Chandigarh in CWP no. 28459 of 2029. The
said order reads as under:
“1. The grievance of the petitioners is that their
proposal for grant of sanction to construct
residential houses in Village Nada and Karoran,
District Mohali, Punjab, which are situated close to
the Sukhna Wildlife Sanctuary, are not being32
processed by the concerned authorities.
2. Learned counsel for State of Punjab has drawn
the attention of this Court to recent interlocutory
order passed by Apex Court on 14.02.2024 in Writ
Petition(s) (Civil) No.202 of 1995, titled as IN RE:
T.N. Godavarman Thirumulpad Vs. Union of India and
others, whereby, I.A. No.263809 & 263810 of 2023,
raising similar prayers as raised in this petition
were kept pending and are under consideration, since
the Apex Court appears to be seized of the matter.
3. Accordingly, the present petition stands
disposed of with liberty to petitioner to approach
the Apex Court.”
2. The limited grievance of the petitioners is with regard
to the non-consideration of the proposal for grant of sanction
to construct residential houses in Village Nada and Karoran,
District Mohali, Punjab which are situated close to the Sukhna
Wildlife Sanctuary.
3. It is their grievance that the proposal was not processed
by the concerned authority.
4. When the matter was heard by the High Court, learned
counsel for the State had drawn the attention of the Court
towards the orders passed by this court in the present
proceedings.
5. This Court in the present proceedings has passed the
following order on 19.03.2025:
“1. Shri Gurminder Singh, learned Advocate General,

appearing on behalf of the State of Punjab statesthat the border abutting Sukhna Wildlife Sanctuary in
the State of Punjab is about 13.2 kilometers. He
states that in the said area there are certain
thickly populated areas and the concern of the people
residing in such areas shall also to be taken into
consideration.
2. Learned Advocate General further submits that the
State of Punjab proposes to have Eco-Sensitive Zone
(ESZ) ranging for 11.2 kilometers from the 13.2
kilometers area. Insofar as the remaining two
kilometers is concerned the learned Advocate General
states that the State Government proposes to have two
100 meters buffer zones where no activities would be
permitted.
3. Learned Advocate General states that the proposal
to that effect would be approved by the Cabinet and
thereafter be forwarded to the Ministry of
Environment, Forest and Climate Change (MoEF&CC),
within a period of four weeks from today.
4. Shri Narender Hooda, learned senior counsel, Ms.
Shalini Kaul, learned counsel and Mr. Dinesh C.
Pandey, appearing for the applicant(s) submit that
the applicants have purchased residential plots in

the proposed ESZ areas. It is submitted that though
the residential activity is a permitted activity
within the ESZ areas, the applications for grant of
permission to carry out constructions are not being
considered by the competent authority.
5. Shri Gurminder Singh, learned Advocate General for
the State of Punjab, states that the respective
Municipal Committees within whose jurisdiction such
plots are situated would consider such applications
in accordance with law and if the plans submitted are
permissible with the requisite height restrictions
there should be no impediment in granting the same.
6. We take the statement of learned General for the
State of Punjab on record.
7. List after four weeks.”
6. Perusal of the order would reveal that Shri Gurminder
Singh, the then learned Advocate General had pointed out that
border abutting Sukhna Wildlife Sanctuary in the State of
Punjab is about 13.2 kilometers. It would further reveal that
for an area abutting 11.2 kilometers, Eco-Sensitive Zone area
would be between 1 to 3 kilometers.
7. He had further submitted that insofar as the remaining
two kilometers are concerned, taking into consideration that
the said area is a thickly populated area and a huge number of

people are residing therein, the State Government proposes to
have two separate 100 meters buffer zones at two different
places where no activities would be permitted.
8. Learned Advocate General had also stated that the
proposal to that effect would soon be approved by the Cabinet
and thereafter be forwarded to the Ministry of Environment,
Forest and Climate Change (MoEF&CC).
9. We are informed by the learned counsel for the State of
Punjab that the Cabinet has already approved the proposal and
the matter has been forwarded to the MoEF&CC for necessary
action.
10. It is pertinent to note that we had also recorded the
statement of the then learned Advocate General for the State
of Punjab, to the effect that the respective Municipal
Committees within whose jurisdiction such plots are situated,
would consider such applications in accordance with law and if
the plans submitted are permissible and are conformant to the
requisite height restrictions, there should be no impediment
in granting the same.
11. We, therefore, direct the MoEF&CC to issue a final
notification with regard to the ESZ for the Sukhna Wildlife
area within a period of three months today after complying
with all the statutory requirements.

12. On such ESZ notification being issued, we direct the
State Government to instruct all the planning authorities
within its jurisdiction abutting the Sukhna Lake to consider
and decide all such applications for grant of permission to
carry out construction and decide the same in accordance with
the provisions made in the said ESZ notification. Such
applications would be decided by the Municipal Committee
within a period of three months from the date on which the
final notification would be issued.
13. In that view of the matter, the special leave petition is
disposed of.

1. We had issued notice in the matter after noticing the
contention of the applicant(s) that the land allotted to the
applicants was not a ‘forest land’ and in spite of that they
were sought to be evicted.
2. The perusal of the order passed by this Court dated
07.05.2022 would reveal that this Court had directed that all
those families who had been identified as having encroached on
forest land prior to 1978 shall be given one month’s notice to
vacate their encroachments and shift to the allotted land.
3. Similarly, this Court had directed that those who had
shifted to the allotted sites but have occupied more land than
they were entitled to shall also be given one month’s notice
to vacate the extra land occupied by them.
4. Learned counsel appearing on behalf of the Andaman and
Nicobar Administration states that the Union Territory (for
short “U.T.”) is not taking any steps for eviction of the
allottees insofar as the original allotment of land to the
extent of one hectare is concerned. It is stated that,
however, only where encroachment is on an area of more than
one hectare, the U.T. is taking steps to remove the
encroachment so as to provide the said land to other eligible
persons.
5. We take on record the statement made by learned counsel

for the Andaman & Nicobar Administration.
6. The applications are, accordingly, disposed of.
7. Needless to state that the allottees shall be entitled to
protection only in respect of the area originally allotted to
them and the Andaman & Nicobar Administration would be at
liberty to take steps for removal of encroachment from the
land held in excess of the original allotment.
