[1] Heard Mr. Albert Keisham, learned counsel appearing for the
applicant, Mr. S. Nepolean, learned senior counsel assisted by Ms. RK Emily,
learned Deputy Government Advocate appearing for the State respondent and Mr.
Serto T. Kom, learned counsel appearing through VC for the respondent No. 4.
[2] The present applications have been filed by the applicant for
condoning the delay of 194 days in filing the appeal counting from the date of
common judgment and order dated 11.05.2022 passed in W.P.(C) No. 260 of 2018
and W.P.(C) No. 504 of 2018 respectively.
[3] The learned counsel appearing for the applicant submits before this
Court that this Court passed a common judgment and order dated 11.05.2022 in
W.P.(C) No. 260 of 2018 and W.P.(C) No. 504 of 2018; the same was uploaded in
the High Court Website on 14.05.2022. The appellant’s counsel communicated
with the appellant on 16.05.2022 and 8 (eight) days were taken for
communicating, regarding the said judgment and order between the appellant’s
counsel and the appellant.

The petitioner started having fever from 27.05.2022 and he could
visit his counsel only on 11.06.2022 and 28 (twenty eight) days were taken in
meeting the counsel. Thereafter, the conducting counsel preferred the present
application before this Court for condoning the delay of 194 days in filing an
appeal.
[4] The learned counsel appearing for the respondents submits that
there is no merit in the application and the said delay has no sanctioned materials
placed before this Court to condone the delay of 194 days in preferring the appeal.
[5] Upon consideration of the submissions made by the learned counsel
appearing for both parties, we are satisfied with the averments made by the
applicant in the present application to condone the delay of 194 days in preferring
the appeal. In such consensus, the delay of 194 days in preferring the appeal is
condoned and the present applications are allowed.
[6] Registry is directed to number appeals and list the matters on next
Monday for admission.
