                                  JUDGMENT

The plaintiff has filed this suit for permanent injunction.

2. Description of the suit schedule property is as under:

All that piece and parcel of property bearing Site No. 1339/C,
Block “A”, New BBMP Khata No. 2066/1339/C, measuring East to
West 50ft, North to South 100ft in the layout formed by The Aircraft
Employees Co-Operative Society Ltd., Bengaluru, formed in Sy. Nos.
6/1, 6/2, 8/1, 8/2, 8/3, 8/4, 8/5, 8/6, 10/1, 10/3, 15/1P, 15/2P, 17P,
18, 19, 21/1, 21/2, 21/3, 22/1, 22/2, 23/1, 23/2, 23/3, 23/4, 23/5,
23/6, 23/7, 23/8, 23/9, 23/10, 23/11, 23/12, 23/13, 25/1, 25/2,

3. Case of the plaintiff is that, the plaintiff is the
absolute owner in lawful possession and enjoyment of the suit
schedule property. The plaintiff purchased the suit schedule
property from K.Pradeep under the registered sale deed dated
15.07.2019. M/s. AECS Society had tendered requisition to the
State Government to form a housing scheme for its members.

The Government of Karnataka based on the representation
initiated acquisition proceedings to acquire the land, under the
Land Acquisition Act, 1894 and acquired almost 350 Acres of
land within Kudlu & Singasandra Village and handed over the
same to M/s. AECS Society for formation of residential layout
and consequently, a residential layout was formed after obtaining
the sanctioned layout plan from the BDA and sites have been
allotted in favour of the members of the Society.

3a) The Aircraft Employees’ Co-Operative Society Ltd.,
is a housing society registered under the Co-Operative Societies
Registration Act
, bearing Certificate No. D/RGN/7675/64, dated
17/18-12-1964, made a representation to the Government of
Karnataka seeking acquisition of lands in and around Kudlu and
Singsandra Villages of Sarjapura Hobli and Begur Hobli
respectively to an extent of 324 Acres 30 Guntas for the purpose
of allotment of residential sites in favour of its members. In
consonance with the said representation, the Government of
Karnataka issued Preliminary Notification under Section 4(1) of
the Land Acquisition Act on 15.04.1988, notifying to acquire 306
Acres 15 Guntas of land in various survey numbers of Kudlu and
Singasandra Villages with a definite scheme to provide
residential sites to the employees of the Aircraft Employees Co-
Operative Society Ltd. In pursuance of the same, on
28.09.1989, the Government issued final notification under
Section 6(1) of the Land Acquisition Act, to acquire 324 Acres 30
Guntas of land in Sy. Nos. 7/1, 7/2, 7/3, 7/4, 7/5, 7/6, 8, 8P, 9/1,
28, 29/1, 29/2, 30/1, 30/2, 31/1, 37, 38/1, 38/2, 38/2, 39/2, 39/4,

39/5, 40, 41/1, 42/1, 42/2, 43, 44/1B, 44/1C, 44/1D, 45, 46 and
46/2 of Kudlu Village, Sarjapura Hobli, Anekal Taluk, Bengaluru
and concurrently notified to acquire land bearing Sy. Nos. 6/1,
6/2, 8/1, 8/2, 8/3, 8/4, 8/5, 8/6, 10/1, 10/3, 15/1P, 15/2P, 17P, 18,
19, 21/1, 21/2, 21/3, 22/1, 22/2, 23/1, 23/2, 23/3, 23/4, 23/5,
23/6, 23/7, 23/8, 23/9, 23/10, 23/11, 23/12, 23/13, 25/1, 25/2,
25/3, 25/4, 25/5, 25/6, 26/1P, 26/3, 27/1A, 27/18, 27/2, 28/1A,

suit schedule property belonging to the Plaintiff is carved out of
land in survey numbers belonging to Singasandra Village of
Begur Hobli.

3b) Pursuant to preliminary and final notification, the
Special Land Acquisition Officer, Bengaluru Sub-Division,
Bengaluru, on 04.05.1990 has passed a consent award in
respect of land bearing Sy. No.25/1, 25/2 and other survey
numbers of Singsandra Village, Begur Hobli, Bengaluru South
Taluk. Thereafter, the Government on 13.08.2003 has issued
Section 16(2) notification notifying to take possession of land

bearing Sy. Nos. 25/1, 25/2 and other survey numbers of
Singasandra Village, Begur Hobli. Bengaluru South Taluk.
Pursuant to acquisition, possession in respect of acquired
property has been handed over in favour Society by the
Government and consequent to taking over possession of the
lands, the Society prepared a layout plan and submitted the
same to BDA for approval. The BDA as per its resolution dated
23.04.2008 vide No.124/2008 has modified the layout plan and
consequently has issued the work order vide dated 17.03.2011
in No.BDA/TPM/PL-31/05-06/5111. By virtue of the modified
plan dated 17.03.2011, earlier layout plan dated 09.03.2001 was
modified or superseded, thus, the layout plan which is prevalent
is the modified plan dated 17.03.2011.

3c) The BDA after modifying the earlier plan, in the year
2011, has issued a Correct Dimension Report disclosing the
dimension of the sites, boundaries of the sites so released
thereto, in which suit property finds place. The Society after
formation of layout and release of sites in its favour, had allotted
the Suit Schedule Property in favour of its member namely
Sri.Pradeep, S/o. Kannaiah and consequently executed a
conveyance in favour of the said allottee vide a registered sale
deed dated 10.02.2012. Pursuant to the sale deed dated
10.02.2012, the BBMP has issued khata in respect of the suit
schedule property in name of Sri. Pradeep i.e., vendor of the
plaintiff. Thereafter, BBMP taking note of the sale deed dated
15.07.2019 executed by Pradeep in favour of the Plaintiff has
issued the khata in respect of the suit property in favour of the

Plaintiff. From the date of purchase of the suit schedule
property, the plaintiff is paying taxes to the local authority. From
the date of purchase, the plaintiff is in possession and enjoyment
of the suit schedule property.

3d) The defendant Nos.1 to 4 claim their right in respect
of land bearing Sy. No.25/1 and 25/2 of Singasandra Village,
Begur Hobli, Bengaluru South Taluk, on the basis of the rights of
their forefather Sri. Chikkanna. Sri.Chikkanna had four sons
namely 1) Agadurappa, 2) Munivenkatappa, 3)
Munishammappa, and 4)Aiayyanna. It is evident from Section
4(1)
, 6(1) and 16(2) notifications, the anubhavadar has been
shown as Sri.Chikkanna. The sons of Sri. Chikkanna being
aggrieved with the acquisition proceedings had challenged the
same before the Hon’ble High Court of Karnataka in W.P.
No.1200-1205 and 1207/1990. Said writ petitions came to be
dismissed on 22.01.2002. Being aggrieved by the same, sons of
Sri. Chikkanna approached the Hon’ble High Court of Karnataka
in WA No. 1172-1178/2002. The Hon’ble High Court of Karnataka
by its order dated 22.07.2003 dismissed the said writ appeals
holding that, the Society has formed layout therein and
beneficiaries under the said Society have already constructed
houses. The sons of Sri. Chikkanna, being aggrieved by the
order of the Hon’ble High Court dated 22.07.2003, approached
the Hon’ble Supreme Court in SLP No.19733-19739/2003. The
Hon’ble Supreme Court by its order dated 07.11.2003 dismissed
the Special Leave Petitions without granting leave in the matter.
The sons of Chikkanna even after failing before the Hon’ble

Supreme Court, started second round of litigation before the
Hon’ble High Court of Karnataka in WP No. 5798/2006
challenging the acquisition proceedings once again. Said Writ
Petition came to be dismissed on 21.02.2007. Thereafter, the
legal heirs of Sri.Chikkanna having failed to secure a judicial
order in their favour, once again instituted a civil suit in OS
No.3635/2009 before the Civil Court for the relief of permanent
injunction in respect of land bearing Sy. Nos.25/1 and 25/2 of
Singasandra Village, Begur Hobli, Bengaluru South Taluk against
the Society. The said suit came to be dismissed by allowing the
application filed under Order 7 Rule 11(d) of CPC filed by the
society on 01.04.2010. The defendant Nos.1 to 4 have no
semblance of right over the suit schedule property. The
defendant Nos. 5 to 11 being strangers along with the defendant
Nos.1 to 4 on 12.04.2021 tried to interfere with the peaceful
possession and enjoyment of the plaintiff over the suit schedule
property. Hence, the plaintiff has filed this suit for permanent
injunction.

4. After service of summons, the defendant Nos.1 and
2 have filed their written statement. The defendant No.10
appeared through his counsel but not filed written statement.
The defendant Nos.4 & 5 remained exparte. Defendant Nos.3, 6
to 9 & 11 are deleted.

4a) The defendant Nos.1 and 2 in their written statement
contended that, originally the properties bearing Sy. Nos.25/1
and 25/2 of Singasandra Village belongs to one Sri.Chikkanna.
Said Chikkanna had four children, 1)Ayyamma,

2)Munivenkatappa, 3)Munishamappa and 4)Agoorappa The
Defendants 1 and 2 are the children of Late Munivenkatappa
and the defendants 3 and 4 are the children of Munishamappa.
Said Chikkanna is the grandfather of the defendant Nos.1 to 4.
During his life time, in order to accommodate his huge family has
constructed several pucca residential houses on the said lands
way back in 1980’s itself. Said Chikkanna also availed electricity
and other amenities to the said houses constructed on
Sy.No.25/1 and 25/2 of Singasandra Village. From the year
1980, said Chikkanna along with his family members was
residing in the said Pucca Houses constructed on the said lands.
The said houses have been assessed to the taxes by the Town
Panchayath and also assigned House List Nos.241 242, 243,
etc. Now, the property is under the jurisdiction of the BBMP and
the revenue authorities of BBMP have issued katha to the
houses and occupants including these defendants are paying
taxes from time to time. Though there were several residential
pucca houses standing in the said lands. The Air Crafts
Employees House Building Co-Op Society Ltd., illegally with
malafide intention got the said lands belonging to the said
Chikkanna notifying for acquisition, for formation of layout for
their employees. Said Chikkanna questioned the acquisition
proceedings before the Hon’ble High Court of Karnataka and
Hon’ble Supreme Court, but was unable to get any relief during
his life time. However, possession of the said properties, which
are in occupation of Chikkanna was never taken by the said
society during his life time.

4b) After demise of Chikkanna, his legal heirs including
the defendant Nos.1 to 4 have succeeded to all the estates left
behind by late Chikkanna including the said lands in Sy.No.25/1
and 25/2. Since an attempt was made by the said AECS
society to illegally demolish the houses of these defendants
constructed in Sy.No.25/1 and 25/2, new Nos.25/7, 8 and 9,
legal heirs of the deceased Chikkanna made a representation to
the Hon’ble Chief Minister on 17.09.2003 seeking deletion of the
land belonging to them from the acquisition proceedings /
modified plan. In view of such representation, survey was
conducted by the Special Land Acquisition Officer, BDA,
Bengaluru in respect of the lands in Sy. Nos.25/7, 8 and 9, old
No. 25/1 and 25/2, wherein it was found and noticed that several
pucca houses, temples, sheet houses, Samadi of the elders of
the family of Chikkanna were standing in the lands in
Sy.Nos.25/7, 8, 9 Old No.25/1, 25/2. After receipt of the
surveyors/Land Acquisition Officer’s report and after further
enquiry, the Commissioner, BDA, called explanation from the Air
Crafts Employees House Building Society, Bengaluru. After
considering all the materials before it, and also considering the
explanation of the said society, the Commissioner, BDA,
Bengaluru, vide letter bearing No.MIS-2351/13-14, directed the
society not to demolish the building in Sy.No.25/1, 25/2, 7, 8, 9
till the disputes are cleared.

4c) After the demise of Chikkanna, in view of
compromise entered into on 05.4.2015, in O.S.No. 90/2015, filed
by one of the legal heir of Late Chikkanna seeking partition of

the properties left behind by Late Chikkanna, these defendants
Rathnamma and Bhadramma were allotted to their share, the
property in Sy.No.25/7, Old Sy.No.25/1 measuring 0-35 Guntas,
and in Sy.No.25/9, Old Sy.No.25/2, measuring 0-14 Guntas.
Remaining property in Sy.No.25/1 and 25/2, New Nos.25/7, 8, 9
of Singasandra Village have fallen to the share of the other legal
heirs of Late Chikkanna. It is contended that, these defendants
are in possession and enjoyment of the properties fallen to their
share as per the compromise petition entered into in O.S.
No.90/2015. It is further contended that, the land in Sy.No.25/1,
25/2, new Nos. 25/7,8,9 and never been taken over by the Land
Acquisition Officer, nor have been handed over to the said Air
Crafts House Building Co-Operative Society, and the said lands
are in actual physical possession of these defendants and other
legal heirs of late Chikkanna, hence, question of handing over
the possession of the suit schedule property in favour of the
plaintiff by his vendor do not arise.

4d) It is denied that, as contended in para-4 of the plaint,
the plaintiff is the absolute owner in lawful possession and
enjoyment of the suit schedule property. As per the defendants,
the suit schedule property is not in existence. It is denied that,
the plaintiff has purchased the suit schedule property under the
registered sale deed dated 15.07.2019 from K.Pradeep and he is
put in possession and enjoyment of the same. In view of the
several rounds of litigations and disputes and in view of the
several buildings existing on the land in Sy. No. 25/1, and 25/2,
of Singasandra, neither the Land Acquisition officer, nor the said

AECS society have taken possession of the said lands.
Therefore, the question of either the plaintiff or his predecessor
in title, being put in possession of the schedule property do not
arises at all.

4e) It is contended that, the suit in O.S.No.3635/2009
filed by the legal heirs of Chikkamma was dismissed on technical
grounds for having not issued notice under Section 125 of the
Co-Operative Societies Act and not on merits. It is denied that,
the defendant Nos.1 to 4 have no semblance of right over the
suit schedule property. It is also denied that, defendant Nos.5 to
12 being strangers along with the defendant Nos.1 to 4, on
12.04.2021 tried to interfere with the plaintiff’s peaceful
possession and enjoyment of the suit schedule property. These
defendants never interfered with the alleged possession of the
plaintiff over the suit schedule property as the suit schedule
property is not in existence. On these grounds prayed to dismiss
the suit.

5. Based on the pleadings, the Court has framed the
following issues :-

ISSUES

1. Whether the plaintiff proves that he is in peaceful
possession and enjoyment of the suit schedule
property ?

2. Whether the plaintiff proves that the defendants are
causing interference ?

3. Whether the plaintiff is entitled for relief as claimed in
the suit ?

4. What Order or decree ?

6. To prove the case, the plaintiff examined himself as
PW.1 and got marked the documents at Ex.P.1 to Ex.P.9. The
defendant Nos.1 and 2 filed memo dated 27.09.2024 and
defendant No.10 filed memo dated 18.02.2025 stating that, they
have no objection to decree the suit. Defendant Nos.4 & 5
exparte. By virtue of the order dated 27.02.2025, the defendant
Nos.3, 6 to 9 & 11 are deleted.

7. Heard arguments from the plaintiff. Perused the
materials on record.

8. My findings on the above issues are as under :-

             Issue Nos.1 to 3              : In the Affirmative,
             Issue No.4                    : As per final order;
                                             for the following :-

                           REASONS

      9.     Issue     Nos.1    to    3:    All   these    issues   are

interconnected with each other, hence they are taken together
for discussion in order to avoid repetition of facts.

10. It is the case of the plaintiff that, he has purchased
the suit schedule property under the registered sale deed

dated 15.07.2019 from his vendor K.Pradeepa for valuable
consideration. It is further contended that, The Aircraft
Employees Co-Operative Society Ltd., Bengaluru, had
tendered requisition to the State Government for supply of land
to form a housing scheme for its members. Accordingly, the
Government of Karnataka acquired almost 350 Acres of land in
various survey numbers within the villages of Kudlu &
Singasandra Village, under the Land Acquisition Act, 1894 and
handed over the land to the said society. The BDA has
approved the layout plan. The acquisition proceedings were
challenged by Late Sri.Chikkanna before the Hon’ble High
Court and Hon’ble Supreme Court, but he did not get any relief.
Thereafter, he started second round of litigation by filing writ
petitions, which also came to be dismissed. Thereafter, he filed
suit for injunction, which also came to be disposed by rejecting
the plaint.

11. In support of his case, the plaintiff has filed affidavit
in lieu of his examination-in-chief reiterating the plaint
averments and examined as PW.1 and got marked the
documents at Ex.P.1 to Ex.P.9. Ex.P.1 is the original
registered sale deed executed by K.Pradeep in favour of the
plaintiff on 15.07.2019 in respect of the suit schedule property.
Ex.P.2 is the original sale deed executed by the society in
favour of vendor of the plaintiff. Ex.P.8 is the possession
certificate and Ex.P.9 is the no objection certificate issued by
the President, the Aircraft Employees House Building Co-
operative Society Limited in respect of the suit schedule

property. Ex.P.3 is the tax paid receipt. Ex.P.4 is the
encumbrance certificate. Ex.P.5 is the khatha certificate.
Ex.P.6 is the Uttara Pathra, Ex.P.7 is the assessment register
extract standing in the name of the plaintiff based on the sale
deed.

12. Though, the defendant Nos.1 & 2 have filed their
written statement denying the case of the plaintiff, but on
27.09.2024, advocate for the defendant Nos.1 and 2 filed
memo stating that, these defendants have no objection to
decree the suit. On 18.02.2025, the advocate for the
defendant No.10 also filed memo stating that, he has no
objection to decree the suit. The defendant Nos.4 & 5
remained absent. The defendant Nos.3, 6 to 9 & 11 have
been deleted vide order dated 27.02.2025. The oral and
documentary evidence of the plaintiff is unchallenged by the
defendants. There is no rebuttal evidence. Looking to the
written statement of defendant Nos.1 and 2, they went on
stating that, the plaintiff is not in possession of the suit
schedule property, hence, it amounts to denying the
possession of the plaintiff, which is nothing but interference in
the possession of the plaintiff. From the oral and documentary
evidence of PW.1, the plaintiff has proved his case and
possession over the suit schedule property. Accordingly, I
answer issue Nos.1 to 3 are in the Affirmative.

13. ISSUE NO.4: In view of my aforesaid discussions,
I proceed to pass the following: –

ORDER

The suit of the plaintiff is decreed with
cost.

The defendant Nos.1, 2, 4, 5 & 10 or
anybody acting on their behalf, are
permanently restrained from interfering with
