Mr. Siddhartha Sah, learned counsel for the
petitioner.
2. Mr. Akshay Latwal, learned A.G.A. for the
State.
3. This petition is filed to quash the charge
sheet, impugned summoning order dated
27.03.2025 passed by Incharge Judicial Magistrate,
Barkote, District Uttarakashi in Criminal Case No.
24 of 2025 under Sections 323, 377, 498-A & 504
I.P.C. as well as the entire proceedings of the
aforesaid criminal case.
4. Learned counsel for the petitioner would
submit that the petitioner and respondent no.2 are
husband and wife; that, the F.I.R. is lodged against
the petitioner on false and fabricated grounds and
the same is filed by the respondent no.2 under the
influence of her mother; that, no offence under
Section 498A I.P.C. of harassment for demand of
dowry is made out against the petitioner as the
respondent no.2 as petitioner were in live-in-
relationship for a long time before marriage,
therefore, the entire proceedings of the aforesaid
criminal case is unsustainable in the eyes of law.
5. Issue notices to respondent no. 2 through
ordinary process and registered post
acknowledgment due as well as through e-mail and
whatsapp, if available.
6. Steps to be taken within two weeks.
7. List this case on 11.07.2025 for hearing on
admission.
8. Meanwhile, the proceedings of Criminal Case
No. 24 of 2025 under Sections 323, 377, 498-A &
504 I.P.C. pending in the court of Judicial
Magistrate, Barkote, District Uttarakashi shall
remain stayed till the next date of listing.
