01. The respondent No. 4 – Shazia Kousser has registered FIR

No. 0013/2024 dated 12.09.2024 with the Police Station

Women Cell, Rajouri against the petitioners for alleged

commission of offences under section 85 accusing the

petitioner No. 1 to have inflicted marital cruelty upon her

read with section 49 of abatement on the part of the

petitioner Nos. 2 and 3.

02. This Court, in terms of an order dated 18.10.2024, directed

notice to the respondent No. 4 for which the petitioners

were required to take steps but the same have not been

taken.

03. Learned counsel for the petitioners seeks indulgence of this

Court to grant time for the petitioners to do the needful.

04. This Court is of the view that the service of the respondent

No. 4 be not left to be carried out by registered post notice

mode but by issuance of a summons from the Registrar

Judicial, Jammu to the respondent No. 4 to be served upon

her by the SHO Police Station Women Cell, Rajouri and,

accordingly, the petitioners to procure dasti summons

from the Registrar Judicial, Jammu within a period of

seven (7) days and deliver same against a receipt to the

SHO Police Station Women Cell, Rajouri, who shall then

carry out service of the summons upon the respondent No.

4 – Shazia Kousser and return the process by or before the

next date of hearing.

05. List on 14.02.2025.

06. Interim direction, in terms of order dated 18.10.2024 to

continue till next date of hearing.
