This application for bail under Section 483 of BNSS (439

Cr.P.C.) has been filed by the petitioner who has been arrested in

connection with F.I.R. No.41/2025 registered at Police Station

Phephana, District Hanumangarh for the offences punishable under

Sections 333, 115(2), 126(2), 118(1), 352, 351(2), 351(3), 307,

3(5) of the BNS.

Heard learned counsel for the petitioner as also learned Public

Prosecutor and perused the material available on record.

Learned counsel for the petitioner submits that the co-accused

Mohani Devi @ Monika and Manju have already been enlarged on bail

by the learned trial Court vide order dated 29.03.2025 passed in Bail

Application CIS No.99/2025. Learned counsel submits that the

petitioner is in judicial custody since long and the trial of the case will

take sufficiently long time, therefore, the benefit of bail may be

granted to the accused-petitioner.

Per contra, learned Public Prosecutor as well as learned counsel

for the complainant have opposed the bail application. However, he is

not in a position to dispute the fact that the above named co-accused

persons have already been enlarged on bail.

Having considered the rival submissions, facts and

circumstances of the case, without expressing any opinion on merits/

demerits of the case, this Court is of the opinion that the bail

application filed by the petitioners deserve to be accepted.

Consequently, the bail application under Section 483 of BNSS

(439 Cr.P.C.) is allowed. It is ordered that the accused-petitioner

Vinod Kumar S/o Shankar, arrested in connection with F.I.R.

No.41/2025 registered at Police Station Phephana, District

Hanumangarh, shall be released on bail, if not wanted in any other

case, provided he furnishes a personal bond of Rs.50,000/- and two

sureties of Rs.25,000/- each, to the satisfaction of learned trial court,

for his appearance before that court on each & every date of hearing

and whenever called upon to do so till completion of the trial.
