1. Ms. Lata Negi, learned counsel for the
applicant.

2. Mr. V.S. Pal, learned AGA, along with Ms.
Meenakshi Sharma, learned Brief Holder for the
State.

3. This is the short-term bail application
moved on behalf of the applicant Harpal Singh
alias Hariyal, who is praying for short-term bail
on account of death of his son, who died on
25.04.2025. The death certificate is enclosed as
Annexure No.3. The applicant is facing trial for
the offences punishable under Section 147,
148, 149, 302, 307, 504 and 506 IPC, Police
Station Ramnagar, District Nainital arising out
of Crime Case No.294 of 2023.

4. The first bail application was rejected by
this Court on 03.07.2024, and, thereafter, the
second bail was also moved and the same was
rejected on 20.03.2025 by this Court.

5. Mr. V.S. Pal, learned AGA, on written
instruction confirmed this fact that the
applicant’s son died on 25.04.2025 and the
presence of the present applicant is also
necessary for the last ritual ceremony which is
scheduled to be held on 08.05.2025.

6. After taking into consideration the fact
that the applicant’s son died on 25.04.2025
and his presence is required on last ritual
ceremonies and being a father, this Court is of
the view that the presence of the present
applicant is essential and the applicant may be
granted short term bail for a period of one
month from the date of his release.

7. Short term bail application is allowed.

8. Accordingly, the applicant-Harpal Singh
alias Hariyal shall be enlarged on short-term
bail only for a period of one month from the
date of his release on his executing a personal

bond and furnishing two reliable sureties, each
of the like amount to the satisfaction of the
Court concerned. It is further directed that, on
expiry of one month, the applicant shall
surrender before the court concerned and
intimation to this effect shall also be given to
this Court, failing which, the concerned CJM
shall issue the warrant as per rule.
