Heard Mr.Kh.Tarunkumar, learned senior counsel
assisted by Ms.Julekha, learned counsel for the petitioners and
Mr.Kh.Samarjit, learned DSGI assisted by Mr.Nongdamba, learned
counsel for the respondents.
By the present petition, petitioners are challenging the
impugned Advertisement dated 13.12.2024 issued by the NIT,
Manipur, for recruitment of Assistant Professor Grade-I, inter alia,
on the ground that contractual employees cannot be replaced by
another contract employee, in terms of the judgment of the Hon’ble
Supreme Court reported in Pradeep Navinbhai Patel & Ors Vs
State of Gujarat & Ors: 2014 SCC online Guj 15846.
Matters filed by the petitioners herein are also listed
on 7.1.2025.
Mr.Tarunkumar, learned senior counsel for the
petitioners submits that the last date for submission of form for the
impugned Advertisement is 5.1.2025 and petitioners’ service is till
31.12.2024.
Learned DSGI submits that vide order dated
18.12.2024, in the connected matters, contractual service of the
petitioners are protected till 7.1.2025 and hence, there is no
requirement of interim order at this stage.
However, petitioners, if so desire may apply for the
impugned Advertisement without prejudicing to their right in the
pending case.
List this case on 7.1.2025 (vacation court) along with
the connected matters.
