Mr. Nirmalya Dasgupta, learned Counsel, is appearing for the

plaintiffs.

2. The plaintiffs have filed the present suit praying for decree for a sum

of Rs. 30,00,000/- along with interest at the rate of 12% per annum.

3. Counsel for the plaintiffs has already initiated pre-institution

mediation process and non-starter report has been issued.

4. Counsel for the plaintiffs submits that the plaintiffs are within the

jurisdiction of this Court and the defendant is outside the jurisdiction

of this Court but the cheques issued by the defendant were

dishonored within the jurisdiction of this Court as well as work order

was also issued within the jurisdiction of this Court.

5. Counsel for the plaintiffs submits that there is a chance that further

damage may be claimed by the plaintiffs and as such, the plaintiffs

have also prayed for leave under Order II Rule 2 of CPC and under

Clause 12 of the Letters Patent, 1865.

6. Considered the submission made by the Counsel for the plaintiff.

Perused the materials on record and pleadings.

7. Leave under Clause 12 of the Letters Patent, 1865 as well as under

Order II Rule 2 of CPC is granted.

8. Plaint is admitted subject to scrutiny by the department.
