01. 1. The petitioner has challenged the order dated
26.09.2016 passed in connection with Khallikote P.S.
Case No.86 of 2011 corresponding to G.R. Case
No.172/2011(A) corresponding to S.T. No.208 of 2016
for the offences punishable under Sections 147/ 148/
341/294/323/324/325/307/506/149 of the IPC
read with Sections 25(I-B)/27 of the Arms Act &
Sections 3 & 4 of the E.S. Act/Section 3(i)(x) of the SC
& ST (PA) Act, pending in the Court of the learned
Additional Sessions Judge, Khallikote, by which the
N.B.W. has been issued against him.

2. Learned counsel for the petitioner submits that
the petitioner was on bail, however, he could not
appear before the learned Court below leading to
issuance of the N.B.W. against him on 26.09.2016.
3. Learned counsel for the petitioner, on instruction,
submits that, the petitioner would surrender/appear
before the learned Court below on or before
10.01.2025 and seek remedy available to him under
law.
4. On the basis of the aforementioned facts and
submissions made at the Bar, the order dated
26.09.2016 passed in connection with Khallikote P.S.
Case No.86 of 2011 corresponding to G.R. Case
No.172/2011(A) corresponding to S.T. No.208 of 2016
pending in the Court of the learned Additional
Sessions Judge, Khallikote is set aside, subject to the
petitioner surrendering before the Court below on or
before 10.01.2025 and depositing cost of Rs.2,000/-
(Rupees two thousand) with the District Bar
Association, Ganjam. Liberty is granted to the
petitioner to avail remedy under law after
surrendering as per the undertaking.
5. The CRLMC is accordingly disposed of.
