1. Heard learned counsel for the parties as well as perused the

material available on record.

2. The instant bail application has been filed by petitioner under

Section 483 B.N.S.S. in connection with FIR No.159/2021 dated

23.06.2021 registered at Police Station Sadar Chittorgarh, District

Chittorgarh for the offence under Sections 8/18, 8/29 of the NDPS

Act and 3/25 Arms Act and 482 IPC.

3. Learned counsel for the petitioner submits that the

contraband has not been recovered from the possession of the

petitioner and he has been falsely implicated from the aid of

Section 29 of NDPS Act. He further submits that co-accused

Jagdish @ J.D. has been enlarged on bail by the Co-ordinate

Bench of this Court vide order dated 29.03.2023 in SB Criminal

Misc. Bail Application No.2599/2023. He also submits that the

petitioner’s case is on a better footing than that of the co-accused

person namely Hanumanram @ Hadmanram, who has also been

enlarged on bail by the Co-ordinate Bench of this Court vide order

dated 21.09.2024 in SB Criminal Misc. Bail Application

No.8855/2024. He submits that there are no previous criminal

antecedents pending against the petitioner and thus, the

petitioner deserves to be enlarged on bail.

4. Learned Public Prosecutor opposes the bail application,

however, is not in a position to refute the submissions made by

learned counsel for the petitioner as the co-accused namely

Jagdish @ J.D. and Hanumanram @ Hadmanram have been

enlarged on bail.

5. In view of above and, having regard to the entirety of facts

and circumstances of the case as available on record and looking

to the fact that the trial will consume time and without expressing

any opinion on the merits/demerits of the case and also looking to

the fact that the co-accused persons Jagdish @ J.D. and

Hanumanram @ Hadmanram have been enlarged on bail, this

Court is of the opinion that the petitioner deserves to be released

on bail.

6. Accordingly, the bail application under Section 483 B.N.S.S.

is allowed and it is ordered that the accused-petitioner Sohan Lal

S/o Bheru Lal Bhepa Ram Bishnoi, arrested in relation to FIR

No.159/2021 dated 23.06.2021 registered at Police Station Sadar

Chittorgarh, District Chittorgarh shall be enlarged on bail provided

he furnishes a personal bond in sum of Rs.50,000/- with two

sureties of Rs.25,000/- each to the satisfaction of the learned trial

Judge for his appearance before the Court concerned on all the

dates of hearing as and when called upon to do so.
