1. Heard learned counsel for the petitioner and
learned APP for the State.
2. The petitioner seeks bail in anticipation of his
arrest in a case registered for the offences punishable under
Sections 147, 148, 149, 150, 151, 152, 171, 341, 342, 323, 307,
332, 333, 337, 338, 120(B), 504, 506, 353 of the Indian Penal
Code.
3. The learned counsel for the petitioner submits that
the petitioner is a person with clean antecedent and in sum and
substance, the allegation in the FIR is that a mob attacked the
police force during Panchayat Election on account of which,
several police personnel sustained injuries. It is next submitted
that FIR was instituted against 42 named and 100-150 unknown
accused and the name of the petitioner was at serial 40 in the
Patna High Court CR. MISC. No.28504 of 2025(2) dt.07-05-2025

FIR with general and omnibus allegation. It is thus submitted
that no specific allegation of assault is alleged against the
petitioner and since petitioner is a resident of a place nearby
where the occurrence took place, as such, he had also gone to
witness the occurrence when he came to be implicated.
4. Learned A.P.P. opposes the anticipatory bail
application.
5. Considering the submissions made by the learned
counsel for the petitioner, the petitioner, above-named, in the
event of his arrest or surrender before the learned Court below
within a period of six weeks, is directed to be released on bail
on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees
Ten Thousand) with two sureties of the like amount each to the
satisfaction of the learned J.M., East Champaran, Motihari in
connection with Rajepur P. S. Case No.178 of 2021, G.R.
No.6230 of 2021, subject to the conditions laid down under
Section 438(2) of the Cr.P.C.
6. The application stands allowed.
