By this Award, I will dispose off the reference dated
29.11.2019 U/s 10(1)(C) & 12(5) of Industrial Disputes Act,
received from the office of Joint Labour Commissioner, District
North, Labour Department, Govt. of NCT of Delhi vide order
Ref. No. F.24(151)/287/ND/Co-II/18/Lab./2372-74 dated
29.11.2019, whereby, the following issue has been referred to
this Court for adjudication:-

“Whether the services of Sh. Pramod S/o Sh. Devidas

Pramod Kumar Vs. Bam Syndicate (India)

have been terminated illegally and/or unjustifiably by
the Management; if so, to what relief is he entitled
and what directions are necessary in this respect?”

2. The aforesaid reference was received by this Court on
04.03.2020, whereafter, Claimant filed his statement of claim on
06.01.2022. Brief case of Claimant, as per his statement of claim
is that he had been working with Management as a counter
salesman, packaging and marketing worker since the year 1993
and his last drawn wage, during his employment with the
Management, were Rs. 15,000/- per month. It is further his case
that during his employment, he was not being provided with
statutory benefits, such as, appointment letter, attendance card,
earned leave, bonus, timely payment of wages etc.
