01. 1. Heard learned counsel for the Petitioner and
learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in
connection with C.T. Case No.1680 of 2019 pending
in the Court of learned J.M.F.C., Chandikhole, arising
out of Byree P.S. Case No.153 of 2019 for
commission of offence punishable under Sections
452
/341/294/354/323/324/307/506/34 IPC.

3. It is submitted by the learned counsel that
earlier the Petitioner approached this Court in ABLAPL
No.17903 of 2019 and this Court by order dated
26.10.2021 directed that on surrendering within three
weeks the Petitioner shall be released on bail.

4. It is stated that because of the supervening
circumstances, the Petitioner could not surrender.
Hence this application.

5. Learned counsel for the State opposes the
prayer for pre-arrest bail and submits that in the
meantime charge sheet has been filed citing the
Petitioner as absconder.

6. Taking into account that the Petitioner was
directed to be released on bail as noted above, it is
directed that on surrendering within three weeks
hence and moving for bail, the Petitioner shall be
released on bail by the learned Court in seisin on such
terms as deemed just and proper subject to
verification of criminal antecedent.

In the event the Petitioner has any criminal
antecedent this order shall not be given effect to.

7. Accordingly, the ABLAPL stands disposed of.
