1. The petitioner through instant petition under Articles
226/227 of the Constitution of India is seeking setting aside of order
dated 04.06.2024 (Annexure P-6) passed by Permanent Lok Adalat, SAS
Nagar, Mohali.
2. The petitioner claims that it is carrying out work of repair of
vehicles. The respondent No.2-Tejinder Pal Singh approached it for
repair of his truck. It carried out repair and charged a sum of
Rs.5,21,697/-. The respondent No.2 lodged his claim with Insurance
Company which repudiated his claim. The respondent No.2 approached
Permanent Lok Adalat wherein he lodged his claim against Insurance
Company though arrayed petitioner as respondent No.2. The petitioner
moved an application before Permanent Lok Adalat seeking deletion of
its name. The Permanent Lok Adalat has not only rejected its application

but also observed that it is an authorized dealer of Insurance Company.
3. Mr. Arjun Kundra, Advocate submits that the petitioner is
not authorized agent or dealer of Insurance Company-Royal Sundaram
General Insurance Company Ltd. and Permanent Lok Adalat has wrongly
declared it authorized dealer of Insurance Company while passing
impugned order. The said order may create its liability at a later stage.
The impugned order may be modified or clarified in the light of claim
lodged by respondent No.2.
4. Without seeking response of respondents, this Court finds it
appropriate to dispose of the instant petition with the observation that the
Permanent Lok Adalat while passing final order shall consider claim of
petitioner whether it is actually dealer of Insurance Company or not. The
observations made in impugned order may not be treated as absolute.
