1. By way of instant writ petition, the petitioner seeks a direction upon

respondent Nos.3 and 4 to confirm and declare the result of the students of the

petitioner-Academy from class 1st to 5th for the academic session 2024-25.

2. It is submitted that the petitioner has been granted provisional

permission to run the academy upto 3rd class with further permission to add a

class every year upto 5th till March, 2020 vide Office Order No.24/CEOR/Pvt.

Schools of 2017 dated 15.06.2017. Learned counsel for the petitioner submits

that earlier the petitioner was running its academy in a rental accommodation

and in the year 2020, after constructing its own building in the same location,

shifted the academy from rented building to its own building, against which a

complaint was moved by a vested interest and respondent No.3, herein issued

a notice dated 10th February, 2020, thereby directing the petitioner to restrain

its territory authorized to run the school i.e. habitation Pattan Gurha within two

days otherwise permission to run the school shall stand cancelled. The said

notice came to be challenged by the petitioner by filing WP(C) No.503/2020.

3. According to the petitioner, on earlier occasions also, when the

respondent Nos. 3 and 4 have not declared and confirm the result of the

petitioner-academy, this Court vide its orders dated 27th April, 2022 and 28th

June, 2024 passed in different applications moved by the petitioner in the

aforesaid writ petition, directed respondent Nos. 3 and 4 to declare and

confirm the result of the students of 1st to 5th classes for the academic session

2021-22 and 2023-24 respectively.

4. Learned counsel for the petitioner states that on 10 th July, 2024, the

petitioner could not cause appearance, due to which the aforesaid writ petition

[WP(C) No.503/2020] came to be dismissed for non-appearance. According to

the petitioner application seeking restoration stands filed and the same is still

pending adjudication before this Court.

5. It is further submitted that the petitioner has conducted the final

examination of the students for 1st to 5th class and all the students have been

declared “Pass” and now the result has to be confirmed by respondent Nos. 3

and 4 for the purpose of authenticity of the result declared by the petitioner,

however, the respondent Nos. 3 and 4 are not declaring/confirming the result

of the students of the petitioner-academy for the session 2024-25. As per the

petitioner, the confirmation of the result shall make the students eligible to get

the admission in the next higher class to pursue the higher studies.

6. Petitioner has relied upon the orders dated 27.04.2022 and 28.06.2024

passed in WP(C) No.503/2020 titled Style of Star Academy of Education v.

UT of J&K and others

7. Learned counsel appearing for the petitioner submits that the petitioner

would feel satisfied, if the writ petition is disposed of by directing respondent

Nos. 3 and 4 to consider the declaration/confirming of result of the students of

the petitioner-academy for the academic session 2204-25, within a reasonable

period to time.

8. Mr. Raman Sharma, learned AAG, who is present in the Court, waives

notice on behalf of the respondents and submits that he would not be averse to

the proposition being made by the learned counsel for the petitioner.

9. In view of the above and in keeping in view orders dated 27.04.2022

and 28.06.2024 passed in WP(C) No.503/2020, this writ petition is disposed

of, at the threshhold, with a direction to respondent Nos. 3 and 4 to consider

the request of the petitioner to declare and confirm the result of the students of

1st to 5th classes of the petitioner-school within a period of two weeks from the

date of receipt of copy of this order.
